Criminal legal aid
At Malcolm & Co Solicitors LLP are proud to act under the legal aid scheme where possible in order to uphold the rights of anyone accused of a criminal offence, no matter their income. We can also offer a fixed-fee service where appropriate and where legal aid funding is not available. Please note, criminal law is the only area where we have a legal aid franchise.​

Please note that if you are charged and are eligible for legal aid but pay for your costs privately, and you are either acquitted or the case does not proceed, then you will not be able to recover your legal costs. If you are represented under legal aid and have to pay contributions, then they will be returned in the event of your acquittal.

How do I apply?
You will need to complete a set of application forms (CRM14 and CRM15). If preferred, we can make you an appointment at our offices for these to be completed, or alternatively, we can send you the forms in the post, along with a self-addressed envelope for you to return them to us.
You are required to supply your National Insurance number when applying for legal aid and stating any of the above. If you are unaware of your National Insurance Number, you can ring 0845 915 7006 to find out.
Legal expenses cover
If you have Professional Indemnity Insurance, you are a member of a union or you work in certain professions (such as a foster carer), you may have a legal expenses attachment to the policy, or you may have Legal Expenses Insurance (LEI) paid for by your Local Authority, employer or provider.

Some of our solicitors are well known to the LEI providers, so we may be able to negotiate with them about costs and then handle your case for you.
Private funding
Our 24-hour private client department provides first-class legal advice and representation to individuals and their families across the full spectrum of criminal and civil law matters. We will provide you with an estimate of our likely costs and will usually ask for some money on account. Our hourly rate is £450 per hour + VAT. Our computerised case management system will automatically track the progress of the funding of your matter, which means that we can provide you with a regular and accurate cost summary.
Funding for all other areas
The only funding options for all other areas except criminal law are: legal expense cover, private funding and CFAs (which includes Deferred Payment Agreements - however, this is only available on a case by case basis). Please contact us for more information.
